1. Who we are and what these terms govern

These terms govern the use of LaunchScope, a service provided by BurstMarketplace LLP, 30 N Gould St Ste N, Sheridan, Wyoming 82801, United States ("we", "the Provider").

By using the service you accept these terms. If you do not accept them, do not use the service.

2. Who it is for

LaunchScope is intended exclusively for individuals acting in the course of their professional, entrepreneurial or commercial activity. By registering you declare that you are acting in that capacity and not as a consumer.

3. What the service does

LaunchScope collects and reprocesses data relating to Amazon marketplaces from third-party professional data sources, and produces analyses using proprietary algorithms and artificial intelligence models.

4. Credits

The service works on a credit basis. Credits are consumed according to the price list published in the service, which may be updated with 15 days' notice.

Purchased credits are non-refundable and cannot be converted into money, except as provided by mandatory rules.

Credits are valid for 24 months from purchase. After that period they expire.

Credits cannot be transferred to third parties.

If an operation fails due to a technical cause attributable to us, the credits consumed are refunded upon your report.

5. Your account

You are responsible for the confidentiality of your credentials and for all activities carried out through your account. Notify us immediately if you suspect unauthorized access.

An account refers to a single user. Sharing credentials with third parties is not allowed.

6. Permitted and prohibited use

You may use the analysis results for the purposes of your business, including commercial decisions, internal presentations and consulting to your clients.

You may not:

• resell, redistribute or make available to third parties the raw data obtained from the service
• use the service to build or feed a competing product
• extract data in an automated way outside of the intended functions
• circumvent technical limits, credit controls or authentication mechanisms
• use the service in violation of applicable laws or the terms of our data providers

Violation of this clause results in immediate suspension of the account without refund of remaining credits.

7. Nature of the data and no guarantee of results

The data comes from third-party sources and are estimates, not certain measurements. Search volumes, sales, revenues, rankings and market shares are estimated values with margins of error that can be significant.

We do not guarantee the accuracy, completeness or timeliness of the data. We do not guarantee that using the service will produce commercial results, sales or profits.

Analyses generated by artificial intelligence are automated processes and may contain errors or imprecise interpretations. They should be considered a decision-making aid, not professional advice.

Every business decision you make based on the service is under your sole responsibility.

8. Service availability

We strive to keep the service available, without however guaranteeing absolute continuity. The service may be suspended for maintenance, updates or causes beyond our control, including unavailability of third-party data providers.

Requested scans are usually processed within a few minutes, but the times indicated in the service are estimates and do not constitute a contractual commitment.

9. Intellectual property

The software, the interface, the processing algorithms and the LaunchScope and BurstMarketplace trademarks are our exclusive property.

The underlying data comes from third-party sources and remains owned by the respective providers. Access granted is limited to the use provided for in these terms.

You may freely use the analyses produced for you within your business, within the limits of article 6.

10. Limitation of liability

To the maximum extent permitted by applicable law, our overall liability towards you, on any grounds and in any period of twelve consecutive months, shall not exceed the amount you paid in the twelve months preceding the event.

We are not liable for indirect damages, loss of profit, loss of business opportunities, loss of data or reputational damages.

No limitation applies in case of willful misconduct or gross negligence, nor in cases where the law does not allow limitations.

11. Indemnification

You agree to hold us harmless from third-party claims arising from your use of the service in violation of these terms or of the law.

12. Term and termination

You can close your account at any time. Remaining credits are not refunded.

We may suspend or close your account in case of violation of these terms, non-payment, or use that harms the service or other users. In cases of serious violation, suspension may be immediate.

We may discontinue the service with 60 days' notice. In that case we will refund unused credits purchased in the previous 12 months.

13. Changes to the terms

We may modify these terms with 15 days' notice via email or a notice in the service. By continuing to use the service after they take effect, you accept the changes. Otherwise, you may terminate.

14. Governing law and jurisdiction

These terms are governed by the law of the State of Wyoming, United States of America, excluding conflict-of-law rules.

For any dispute, the exclusive jurisdiction lies with the courts of Sheridan County, Wyoming, United States.

Any mandatory rules applicable due to your country of establishment remain unaffected.

15. Final provisions

• If a clause is found invalid, the remaining ones remain effective.
• Failure to exercise a right does not constitute a waiver of it.
• You may not assign the rights arising from these terms without our written consent.
• These terms, together with the Privacy Policy, constitute the entire agreement between the parties.
